What Happens After a DUI Arrest in Los Angeles County?

After being arrested for DUI, you may have many questions, such as:

  • How long will my license be suspended?
  • How much will I have to pay for a DUI attorney?
  • How much jail time will I face?
  • How long will my DUI case take to resolve?

Unfortunately, there are no definitive answers to these questions. Each case is different, and the outcome depends on a variety of factors. However, there are some general guidelines that can be followed.

First, the arresting officer will fill out a standardized California Department of Motor Vehicles (DMV) form, known as an SF-11. This form will detail the arrest, such as the time, date, and location of the arrest, as well as the reason for the arrest. The SF-11 will also include the officer's opinion on whether or not the defendant was under the influence of alcohol, drugs, or a combination of both. The arresting officer will also provide information on the defendant's performance on the Standardized Field Sobriety Test (SFST), as well as the results of the preliminary alcohol screening (PAS) test.

Next, the defendant will be issued a temporary license restriction (TR) of no driving under the following circumstances:

  • If the defendant is under 21 years old, they will have a full year license suspension.
  • If the defendant is 21 years old or older, they will have a six-month license suspension.
  • The TR will also prohibit the defendant from driving with any measurable amount of alcohol in their system.

After the arrest, the next step is for the defendant to contact an attorney. The sooner the attorney can be contacted, the better, as the sooner they can begin working on the case, the better the chances of resolving the case in the defendant's favor.

At this point, the attorney will begin the process of reviewing the officer's report and any other evidence, such as the SFST report and/or video footage. The attorney will also conduct an investigation into the arresting officer, as well as the arresting officer's training and experience. The attorney will also conduct a thorough investigation into the defendant's background, including any medical conditions or physical disabilities that may have played a role in the defendant's performance on the SFST.

What Is the Standardized Field Sobriety Test?

The Standardized Field Sobriety Test is a series of three physical tests that are designed to determine whether or not a driver is under the influence of alcohol. The three tests are the walk-and-turn test, the one-leg stand test, and the horizontal gaze nystagmus test. Each test is designed to test a different physical function that is believed to be impaired by alcohol.

The walk-and-turn test is a test of a driver's ability to maintain their balance while following instructions and walking in a straight line. The officer will instruct the driver to take nine steps while listening to the officer's instructions. The officer will then watch the driver walk in a straight line for nine steps, turn, and walk back in a straight line for nine steps. The officer will be looking for eight indicators of intoxication, including the driver's inability to listen to and follow the instructions, the driver's inability to walk in a straight line, the driver's failure to turn in the instructed direction, the driver's inability to keep their balance while listening.
